Re: God Emperor Megathread (Trump and his presidency)
The letting POTUS pick the supreme court seems extremely flawed when you think about it, why wouldn't he of retired when Obama was still around?

The President makes all Federal Judicial appointments
Either because he didn't want Obama to appoint his successor (hence why Ginsberg refuses to retire or drop dead) or because he was younger back then and didn't feel the need.

->>The President appoints new Supreme Court justices, but the Senate (and only the Senate) gets the vote to confirm the appointment before they can take the bench. So if Trump appoints Yosemite Sam or Shitlib Extreme or tries to do anything else wacky the Senate can deny confirmation and Trump would have to pick someone else.
->>Both Democrats and Republicans have changed the rules recently so that only a simply majority is needed to confirm a judge (it used to take 60 votes). If there is a tie vote, the Vice President is the tie breaker. Because Republicans have the Senate majority at least until next January there is literally nothing the Dems can do to block Trump's pick from within their own party. Their only hope is that some Republicans break ranks and deny confirmation (which is historically rare and didn't happen at all when Trump appointed Gorsuch).
->>Kennedy's decision to retire now almost certainly means that he wanted Trump and the Republican Senate to choose his replacement (keep in mind Kennedy was appointed by Reagan in the late 80s). There is currently about a 50/50 chance that the Democrats will have control of the Senate starting in 2019 and if that occurs the Dems will just deny any Trump choice and leave a vacancy on the court until after the 2020 presidential election.
In the end, although the media paints Kennedy as a "swing vote" his record was generally right leaning so swapping him with a Trump appointment won't change that much and the only justice that really want to outlaw abortion and end gay marriage is Thomas so the Twitter libs are just having a meltdown because they get off on it.
The real hotness would be if the Republicans hold the Senate and Trump gets re-elected because Ginsberg and/or Breyer likely won't survive 6 more years and Sotomayor is a fatty that could catch the beetus any day. Replacing one or more of those judges with Trump appointments would cause the court to have a rightward slant. That might lead the Dems to stack the court with additional justices once they get back in power, which would be a glorious shitshow.

Re: God Emperor Megathread (Trump and his presidency)
What's funny is if he wins again he'll probably get to name a 3rd Justice after Ginsburg finally gives out. Obstruct all you want, bitches, but the court's going to lean to the right for years.Keith Chegwin wrote: ↑Mon Jun 25, 2018 9:00 amAt this point I don't see how Trump couldn't get another four years, unless they rig it.
