They could have agreed custody during the divorce, OR they considered him re-marrying to be a more stable enviroment for the kids to grow up in.

IIRC the reason they gave him custody was because the mom had some mental disorder. Not even a really terrible one, either. Something as simple as Bipolar or another easily treatable condition as long as you stay on your meds.
